## 法律地位

**经授权后允许.** 根据2024年1月1日起施行的《无人驾驶航空器飞行管理暂行条例》，最大起飞重量不超过150千克的农用无人驾驶航空器在农林牧渔区域上方的适飞空域内作业，无需取得运营合格证和操控员执照，也无需提出飞行活动申请；但操控人员须取得生产者颁发的操作证，农药须严格按照标签使用。

## 所需条件

## 如何获得授权

## 施药作业限制

- 豁免仅适用于最大飞行真高不超过30米、最大平飞速度不超过50千米/小时、最大飞行半径不超过2000米、具备空域保持和可靠被监视能力、最大起飞重量不超过150千克、在农林牧渔区域上方适飞空域内作业的农用无人驾驶航空器（条例第十一条、第六十二条）。
- 真高120米以上空域、机场及周边、军事、边境等敏感区域上方为管制空域，须经批准（第十九条）。
- 严禁在饮用水水源保护区内使用农药（《农药管理条例》第三十五条）。

## 须知

- 未取得操作证从事常规农用作业，由县级以上农业农村主管部门责令停止作业，并处1000元以上1万元以下罚款（第五十条）。
- 2025年1月23日前持有的有效操作证继续有效。
